I am separating from my husband of 5 years, we lived together for 13 years. House will be split 50/50. Equity approx. £150k I have no pension, he has private pension of £220k. He is 51 and I am 53. He earns around £26k pa I earn £11k pa. No children. Would I be entitled to some of his pension. I am debating whether to go for pension if possible or ask for more out of the equity in the house when sold. The split is down to him and I will be leaving a beautiful 4 bed detached home and can only afford a very small mortgage. I obviously will downsize drastically and have to move areas.

I will be seeking legal advice, I just wondered if I would be entitled to his pension as this would enable me to buy a house I have seen rather than go for one that I could just about afford but in an area I don't like. I hope when it comes down to the nitty gritty my husband will give me more equity rather than me touch his pension. But I need to find out what percentage I could get from his pension before giving him a figure I want from the equity.

Its up to your Solicitor to get you as much out of this divorce as possible, but, as I understand it, there is nothing in the law that says that you MUST receive some of his pension.
Talk to your solicitor about a pension share. You may be entitled to a percentage, but I'm not sure you'd be entitled to it until you reach pension age.
You may just have to accept that you may only be able to afford to buy in a less desirable area. I know I did...even with half the proceeds of the house.
