Said friend is a nurse who works nights on a nursing/EMI unit. One of the carers is always falling asleep and she has trouble waking him. She and a few other members of staff have all reported this to management, the management told her the next time it happened she was to record this on her phone so that they had evidence. She did this and now the carer has told her that he has consulted a solicitor and that she has fourteen days to hand over the pictures and that he is suing her because these pictures were taken on the unit and without his consent.
Obviously she is worried about this. Question is can he sue her?

whatever happens she is covered by employers liability
so WHEN the letter arrives hand it to her employers

this issue is straightforward
he wouldn't be the first person to fall asleep at nights. any a time when I was in hospital I would get up in the small hours for a Jimmy, only to find them all zonked out cold round the nursing station.

ANYWAY - wait for the letter and do nothing until then
I doan wanna say too much because the filmed employee has to pay and the photographer doesnt - she was following employers orders

so the photographed laxy sleeping employee has to pay a lawyer to do the ground work and the filmer - - - doesnt

I doubt he will pursue a legal claim but, if he does, I completely agree with PP

when my brother was in a hospital as a doctor in 1972
he found all the cleaners in the bog sleeping
to be fresh for their day jobs.....
and they ( under the old law) said you had better not tell
or it will be worse for YOU !!!!

times change - - - - a bit

in 2008 when I had my hip replaced in Hope Hospital actually
I heard the gay boy ( male nurse ) say: Euphemia you have to do ONR thing on this night shift before it is over.
It was 5.55 am
She didnt
actually during the night I had called euphemia over to say I was bleeding from my operation site and had soaked the dressing and the bed sheet and she had done nothing .....
[ a little bit more on that story but we are in public]
OK - what happened was that I had called E over at around 3 am who did nothing and so I snatcher her torch to show the bleeding.
Euphemia ( true name ) was gonna allege I had assaulted her by snatching. But there was blood everywhere - so that was kinda - well -
Euphemia didnt complain

I walked oudda the hospital later that day [ 2008]
