Other half is due to have an op and will be off work for a good few weeks. He'll only receive SSP as his employers don't do sick pay. Two of those days he'll be off are bank holidays.

Now because he receives 28 days hol which INCLUDES bank holidays, what will happen there? Should he be given those 2 days back as holidays seeing as they make up his holiday entitlement (and if they didn't then he'd only have 26 days holidays)?

Or what's the position?

Assuming a;; 28 days are paid To avoid any doubt maybe he should book it as a holiday- that way he'll get paid for it. But if he doesn't and he is marked as being off sick he will still have the day left as a holiday to take some other time
Whether the break in absence for SSp would mess u SSp though i don't know. He is best asking at work before worrying about issues of the law

Not trying to claim both! He gets 28 days hol a year but that includes bank holidays. As he'll be off sick on 2 of those bank hols due to op, he's therefore losing out and will have 2 days less holiday. So I wondered if he would get those hols back, despite being bank hol ones, as he'll actually be signed off sick over that period.

Hope I'm explaining this properly!
