Does anyone know if this comes into force only after contracts have been signed? Our seller knocked fifty grand off the price of his house and lo and behold when we got the fixtures and fitting list, many things that were down on the estate agents description are now marked as "negotiable". The agent is trying to smooth things over but remarked that if we'd moved in and then found they'd taken things they weren't supposed to, that's when the PMA would come into effect but I'm not so sure. Has anyone any ideas? Thanks.

Property misdescription applies from very early, if the estate agent has given you incorrect information which would have made you act in a different way to that which you would have done if the incorrect information had not been given. However the Property Misdescription Act 1991 is due to be repealed this year and your protection will be the Consumer Protection from Unfair Trading Regulations 2008.

We've managed to get it sorted out now and have more or less got what was stated-good to know the estate agent was wrong though! The fifty grand was knocked off in my opinion because it was overpriced and now the sellers have found somewhere they are wanting to get things moving.
