Sorry not sure if I have put this under the corrrect heading. We purchased a settee end December and received it end February, when it arrived it was nothing like the one in the showroom, none of the seems matched and one part of the settee back was a lot higher than the other two, also its a electric recliner and when you recline it is so noisy you literally cannot heathe TV. Someone came out a weeks later from Customer Services and said it had been made incorrectly and would have to be remade. We told the store that we didn't want another one the same and would rather choose a different one of the same value but were told we had to have one the same kind. Now only after 8 weeks a split has appeared in the leather on one of the seats, we have had repeated conversations with the store but to no avail. They said the replacement would be arriving 18 May but we don't want it, we want a refund now. What are our rights. Thanks.

Under the sale of goods act you are entitled to a full refund, inform the shop that. "under the sale of goods act I am entitled to a full refund so please arrange to have the goods collected within 14 days and refund the costs" also a registered letter to the shop or their head office on the same lines would help, if they try to deliver a replacement refuse it. Should they try to get out of this, inform them that you will pursue the claim through the small claims court.
Your statutory rights under the sale of goods act 1979 are that the product must be:

Satisfactory quality
Suitable for purpose
Description must be accurate

You are entitled to goods that do not need repairing or replacing, make it clear you are rejecting the goods as faulty and not matching the description provided and insist they provide you with a product that satisfies your statutory rights. You do need to act reasonably quickly, write as soon as possible and keep a copy of your letter; you may wish to use recorded delivery.
as above..do not be fobbed off...the trading standards office at your local council will help you if you need it !!!
i personally would record the dates of every contact with them
as if it gets a bit underhand this will help you later on
good luck and of course let us know how you get on.
its only fair!
ditto!

do you have a neighbour or relative who can kick @r$e on your behalf?
