Something has got me wondering. If a man and woman marry and during their marriage the man has gender reassignment surgery to become a woman, does the marriage remain legally binding? As two people of the same sex can not be 'married' does their relationship change to a 'civil partnership'?

So they remain married in the same way as when they were man and wife, even though the man is now not a man?

Yes...they are married in the eyes of the law.
But they wouldn't be of the same sex, so no 'problem'. There would be one appearing to be the sex they are, and the other mimicking the sex they wish to be.

I'm pretty sure the fishman is not attempting to be a woman. If he is, it's not going well.

Just some people I know in this position.

OG - I was under the impression that when you have this surgery you are then legally now a woman, not a man.
Legally ? Well you may have a point but there is an awful load of nonsense deemed to be official that just ends up complicating a situation. I was considering the issue from a reality point of view, which it seems, if the marriage is still legally a marriage, the law does too. I guess one part of the law need not be consistent with another part of the law.
Quite, Old-Geezer.

Cutting a dog's nuts off doesn't make it a bitch - it makes it a dog with no nuts.

Regardless of whatever surgery a person has, if they were born male will always be male and vice versa.

Are you saying a woman must have a uterus to be a woman? What about those women who have had hysterectomies, are they no longer women in your eyes?

You know exactly what Eddie means Daffy
No I don't know what he means, he should be clearer.

What about people born with ambiguous gender (born with full male and female reproductive organs), where do they fit in your opinion?
Absolutely daffy - some people know nothing about the spectrum of sexual identities, not only in the mental state but the physical too.....
If in doubt; check the chromosomes.
I am quite frankly horrified that people still think in this way!
