I was recently arrested on the charges of assault by beating and Possession of an offensive weapon, namely a knife. I have denied all charges, as I was never found with said knife. I have two statements against me and my statement countering theirs. This is all the evidence they have for court. It is true isn't it, that without hard evidence and only two peoples word (whom are a couple), they can but only throw it out of court??? Neither of the two are willing to attend court either. My only worry is I have recently been released from prison on very similar charges. Although I did get bail also for this offence. Any help please? Cheers.

...so where did the suggestion that you were carrying a knife come from? any police eveidence? what circumstances?

Did you have a knife?
If their evidence doesn't count maybe you can get off teh whole charge and say "it wasn't me"
If someone has been assaulted then their injuries would carry some weight and might help back up their story.
Do these people making the allegations know you?
The fact that you have form for similar offences would also count against you.
You say the witnesses were a couple. Was one of both of these also the victim ?
Were they your Ex and her new boyfriend?

Why would they throw it out of court?

Not every crime has witnesses.
Are you asking whether the whole charge ('assault by beating and Possession of an offensive weapon) is likely to get thrown out or just the 'possession of an offensive weapon' bit?
You say you weren't found with a knife but did you actually use one in this assault?
Were either of the witnesses also the victim and did you use the knife to cause any wounds?
I think we're all going over the same ground now and scracy seems to be aving us to it.

Things like this, and much worse, happen everyday. Scracy probably googled and got led here. As it is there first question you cannot presume it's a wind up...or trolling.

If you have been 'charged' then the police / CPS reasonably believes there is sufficient evidence to provide a realistic prospect of conviction for the offence.
their evidence is as good as yours; if they say they saw you with a knife and you say you didn't have one, the court would decide whose sounds more believable. The police evidently think they have enough to go on to arrest you.

But on an assault charge, I'd sort of expect them to be able to provide some sort of victim.

thank you to some and no thanks to others. i was never found with a knife on my person. the people are indeed my ex an new boyfriend. the only evidence the police/courts have to go on is other people accounts.
