My council declined my and my partner’s application on basis that she does not live with me. The problem is that she is a full time post graduate student and attends 2-3 day a week at uni. I have received a written request to submit the claim form only with my name on it. Reluctantly I did.
Now we have problems with the claim. The council has been successfully stalling our claim since November requesting all sorts of proofs. It is not the first council I dealt with and I am aware that they have to do a thorough check before paying out. That is fair enough but refusing my claim unless I provide audited accounts of my employer and companies bank statement my claim is not going to be dealt with? This ordeal has been dragging for 3 months and my home is under thread as my landlord issued possession notice on the 15 of Dec. I'm being asked to produce documents that have not yet been issued such as on the 4th of December I had to produce Decembers pay slips. In January I was asked to produce Januarys pay slip when I submitted my December one. That was on the 10th and I was advices that unless I provide this my case will not be looked at.
Talking to their phone staff does very little as you feel like to taking to 1st graders with very little knowledge of what they should be proficient in.
I need a legal help as only thanks to my landlord we still have a roof over our heads but I am sure we deserve compensation and this racist or ignorant council deserve to be exposed for playing with peoples life's.

start from the start - I know you're upset - what exactly were you applying for?
Are you attempting to claim benefits? If so and you aren't married why do you think you should be abe to claim for your girlfriend? She's got her own life by the sound of it and you have been told to claim by yourself on the same basis.

I'm a little confused here. What might this have to do with 'racism'?

Hi thanks for your answer. To explain I have run out of 2000 word limit but I try in short:
In November me and my girlfriend whom I live with and moved together from our old council house to another ch under council swap scheme that we were on for the last 4 years. We have been living together as partners for over 4 years. Last year 09 she applied to uni for a post grad course 2-3 days a week at uni in Bolton. Some months later unexpectedly our swap came through and we got the opps to move and we did but my partner did not want to drop out so she goes to Bolton for couple of days and stays with friends. When we have both submitted our application it was refused on basis that my partner cant live with me because she is a student...I got a letter stating that she does not live with me and I have to just fill out my part. I reluctantly did that and submitted all usual papers but it was not enough. The council had gone the extra mile and been asking for all sorts of papers that are either not yet been issued like asked me on the 4th of Dec to produce Dec pay slip or Workers Registration Certificate that I am except as I had been self employed for 2 years and then I have incorporated my company and by default I was made a company director.
It took them a month to realize their error only when I started an argument on the phone and some line manager took over just to confirm that I was right.
I had to bring in my company registration certificate that I believe is excessive and now I have to disclose financial reports and company bank statements.

As far as the Data Protection Act goes I can disclose those base on a County Court Judgement if a serious crime was committed. What to do? Do I have a claim against them? How any council can deliberately stall your claim and request your employers confidential information?

You are trying to claim benefits then! You aren't married and you are working. Why do you expect the British tax-payer to pay for you and your girlfriend? I can't believe you have the audacity to come here and expect the UK to do this! Would the Polish authorities allow you to hold your hand out for money like this?

Do you have an employer, or are you self employed, or are you a director of a company?

it is not a wind up. I was self employed but then I have incorporated my company and now it is a LTD business. I still do the same job but not as my self but as an employee of my limited company
Your grasp of English is getting a lot better.
Right, you have your own company so of course the council wants a lot more information.
Your company could be making millions, and you could be paying yourself pennies, on paper.
Sitback ummm and watch this go pearshaped. So much like other threads popping up late on Fridays. Frustration must be set in on the other side after 15 days of inactivity.

Since we moved my business hit a bit of a snag and we were forced to go and claim.
I saw how another person before me was treated including all the help with filling up the form. I received slightly colder if not rude reception. I have tried to describe this mater in greater detail but I have run out of space as you can only post 2000 characters here. It is really complex difficult case but my other council did not give my such run around for nothing and I had the opportunity to present my case to an Asian advisor who had proficient knowledge of my circumstances. Also I have not seen one foreign person in my current council. No one took any notice of notice of seeking possession of my house untill I had an argument on the phone with the council and pointed out this letter in their system submitted in December. A case that was suppose to be dealt with as "emergency" because we are loosing our home now.
