hi guys i have been given an eviction date.......from my council property. when the bailiffs arrive can i tell them i am squatting. i have been given a legal notice to put in my window and have been told to barracade the doors until the bailiffs keave......help please any one...lee

if it just means a bit of breathing space to get a new place or to sort out some money,,,,,it is rent arrears...i am ex forces ,left the army and started work ,was made redundant and claimed housing benefit was told everything was ok....but it wasnt ...they didnt pay my rent .now being evicted due to this.
Is the council not admitted to it's fault?

I don't think bailiffs are allowed to break in so make sure all windows are also closed. I think to get in they need a court order and the police.
right phone national debtline now for immediate advice they are brilliant with this kind of thing !!!!!!
they cannot send baliffs in unless it has gone to court !!!

i had the eviction order delivered to me the other day...any ideas the council wont admit fault.....heeeeeelp ...lee
housing benefit will inform your landlord that you are due the back rent so it will be paid as soon as they sort their paperwork out

the council know this about the HB and are even part of the same organisation so they will accept their word

is there more to thsi than you are letting on?
seriously call national debtline google it to find the number they are really good !!!!
Is it an eviction order from the council or from the court?

You can apply for a stay of execution. You'll sit with a judge and explain the circumstances...he will then decide how long to give you. Usually something like 3 months.

nope hb said they had no copies of our claim ....then all of a sudden 3 mths ago the council started to pay our hb ,but said they couldnt back date it because of the time span of our claim ....i had made 5 separate claims ...a person i spoke to said they had found the claims but the time span was so far apart they refused the backdated monies

Contact both the Royal British Legion and SSAFA straight away. Both will be able to give you advice, legal help, and if needed, financial assistance.

As ex-army you have a support network there for you. So use it.

my rent is being paid at the moment....but can i squat for the time being to buy me some time the council want the full amount of arrears...ive contacted ssafa and rbl both said too short notice...........

the eviction is wed....and the courts can only give friday as a date before a judge...
They might not even turn up on Wednesday. Get an appointment for Friday and keep your doors locked.
It may be too short notice to be able to do anything to save your current house but they will be able to help find and move into your next location, and they'll also be able to assist you in making sure a clusterfcuk like this never happens again.
