About 3 years ago my father signed a mortgage agreement to allow his then girlfriend to get a mortgage on a house. He doesn't pay any money into the mortgage and won't receive any money when the house is sold as that was the agreement. His now ex girlfriend asked for him to sign against the house to get a loan and he refused and now she has threatened to not pay the mortgage so the debt collectors will come after him. The bad news is that she is very bitter and has refused to take his name off the deeds. Is there anyway to remove his name?

Well if she is breaking her part of the agreement (which was always a bit precarious by the sound of it) then obviously he has one card to play and that is that if he is on the deeds or the joint owner then he will be entitled to some of the proceeds when it is sold or he has an 'interest' in the property. There is a lot more that needs to be explained though i.e. why did your father enter into this arrangement, did he already have another home, in which case he might have to pay capital gains tax, is he definitely on the deeds or just on the mortgage etc.etc. If all else fails he could possibly pay the mortgage perhaps and buy her out. There are so many different outcomes. I think if she is acting in this way it would be best not to remove his name !! Is there any equity in the property ?
