Hi,

I am insured with More Than - part of Royal Sun Alliance

Some stupid idiot drove in to the side of my car whilst I was driving and not only did it cause the whole left side of my car to be replaced, but it also caused damage to my gear box and clutch.
My car is a 147 Alfa salespeed. - anyway the car was looked at by the Alfa Dealer who said that the problem with the gearbox a pre-existing condition and was down to wear and tear and refused to fix it, but issued a quote of approx 2,500.00.

However, when I initally called the MoreThan I advised them of the accident, Advised them that no only was there body damage, but also it was not driving the same.

The car was taken to be fixed of so say and afetr the bodywork was done, the garage called and advised that we could come and get the car and Morethan would contact us to arrange the machanical repair.

I had to call Morethan because the car felt totally unsafe to drive. The car was looked at and then I was told that it was not caused by the accident.

However my argument is that the car was driving ok and even if it had a wear and tear, it was not effecting it.

I believe that the impact of the huge van that hit in to me actually caused what was wear and tear turn in to a major prob lem that has resulted in me not being able to drive my car!!!!

Morethan have left me without a car and totally in the lurch.

What are my rights?

none really, the car has been looked at by alfa, who say what they have said about the gearbox,so if its down to wear and tear, your insurance will not pay for it.i am in the motor trade and i doubt very much, myself, from experience that any damage was caused in the accident to the clutch and gearbox,if it had, the car would have been a write off,as it would have had to be moved over in the impact and the chassis would have been bent.
