and breathe.............!
I know if somebody drives into the back of you, they are generally deemed to be at fault but I don't think there is any hard and fast rule about who is in the wrong on a roundabout.
Question Author
the car was like nearly over the round about so the back of the car was still on the circle bit and the driver of a van hit the side of me so im not sure
I don't think most of the info is relevant to who the insurers/police would consider to blame as it's very difficult to prove who indicated and when.
Sorry, I didn't mean to submit at that point. If you pulled out in front of someone who was already on the roundabout then you'll probably be at fault. If they entered after you or pulled into your lane, therby hitting you, then they are probably to blame
surely when entering a roundabout you give way to traffic from the right, that is, already on the roundabout.
When I worked at an crash repair centre, the insurance assessor used to almost always give 50/50 for roundabout collisions.
I assume you have reported this to your insurance ? If just leave it to them that is what you pay for. However it will be virtually certain to be 50/50 .
I am not sure from your post exactly what happened, did you brake to avoid the other car that 'changed his mind' or was that the car that hit you?
Question Author
i was going strait i didnt break i kept going he was on the right of me but i was on the round about first how can the guy claim of me when he hit me
Are you from Malta?
Question Author
i mean i was like more then half way through the round about becouse all i got is couple scratches on my car thats it
Question Author
no im from lithuania whhat that got to do with anything
Just that the road rules in Malta are completely at odds where roundabouts are concerned, than how we view the rules over here.
If a car hits you on the right hand side on a British roundabout, it's your fault, you have to give way to those coming from the right, even if they indicate to turn off the roundabout you should not assume they will actually turn off.
Also remember - you do not over or undertake on a roundabout!
