3rd party insurers, wont communicate

Hello, son was involved in a car accident when coming home from work. he was travelling down a country lane only wide enough for a single vehicle ,when a car pulled out of a junction, hitting his front wing and scrapping the car all down one side. The young lady passenger decided to ring the police, which was a good thing really as her driver had started to threaten my son. The police arrived and told my son that the other driver was completely at fault for pulling out of the junction into his right of way. Case number,police officers number was given to my son. 8 weeks later after giving the insurers allthe info they need, the 3rd party insurers are now disputing who was at fault.but they will not comunicate with my insurance company at all. Can i do anything

But surely that is what the insurance company is for, to sort this out for you?
Yes, first write to the other driver telling them that if you are not contacted, say within 1 week, you will use the court to recover costs against them directly. That will very quickly get them to kick their own insurer into line. If not go and file small claim at the court, against the driver personally NOT the insurer. However the threat alone will probably be sufficient.
Your insurer should sort all this out.
However if you also suffered some personal injury then a letter seeking compensation often helps focus attention

even though im insured with Admiral, any claim is passed on to a company called Albany. I have rang them on a dozen occasions and have never spoken to the same person . Maybe speaking to someone higher up the ladder may push them into action, but know i wont get past first port of call
You need to ascertain the Third Party's Insurers. The police who were called to the scene of the accident will be able to give you this information.
"Albany" are not an Insurer. They are a claims facilitating company.
Are you sure that they are acting on behalf of your Insurer here,and not on behalf of the TPs Insurer?
Talk to Admiral - they are your insurers - you pay them, get them to take some action.

Update, son has spoken to admiral, they have informed him that 3rdpi have all the info they need from us ,but even though their client has claimed he is not at fault , he is not responding to emails ,phone calls ,letters etc. This can go on for upto 90 days ,after which his insurers can pay up to get sons car fixed, as a sign of guilt from their client, or they can just wash their hands of the case,and pay nothing. The only way to reclaim costs then is to take 3rd party to court, and then use bailiffs to reclaim costs if he doesnt pay up , which as they are both smackheads will probably be the likely route............ like to ask ,Why cant 3rd pi (after all our evidence and police report points to their client being at fault ) just pay up anyway........... and IF 3rdpi decide to not pay up , can they be taken to court. thanks for info very grateful
I still say it's up to your insurer to worry about these things.
Are the repairs not being done yet then? Surely you're not expected to manage several months without a car
The other insurer can't "wash their hands of it" just because their policyholder doesn't reply.

repairs to sons car have not been done, luckily the motor is drivable. I always thought that unsurances collected info, diagrams, photos, description of accident, then with all evidence in front of them, sorted out ,who was at fault. cant understand why TPI cannot see their client is at fault and pay up.
Shouldn't your son's insurer pay for the repairs under his policy and then they try to recover the money from the other party's insurer.
Has he asked them how to get the repairs done/paid for?

he was driving his wifes car as his was off the road for one day, no named drivers, so only third party.

dont insurances sort out between themselves who is at fault for an accident
Normally, in my experience, yes (from my claims days), but they do depend on both sets of insurers getting the information from their policyholders. If the blame is in doubt, they'd use knock for knock and share the costs.

TP is denying fault hes saying , yes i pulled out of a junction with a give way sign, but he (my son)was coming past and didnt swerve to get out of my way ,and he made me hit him. This is something like his reason hes not at fault, surely NO insurance company could agree with this excuse. Even police report says hes at fault , so i cant undrstand why his insurance wont pay for repairs.
