50/50 car insurance claim

I had a car crash in october 2009. single track road on a rainy morning, collided with oncoming vehicle. Police came and did there stuff(breathalysed/arranged recovery). Police man said as far as he was concerned it was 50/50 blame and if we were happy he would leave it as that. My car was valued at £275 by my insurance and unfortunately my excess was £350 so i was entitled to nothing. My question is this. Should the other guys insurance have paid out for at least half of the value of my car, i know it's only a small amount of money but just wondered if anyone could advise.

I also suffered some shoulder pain in the days after the accident and had this checked out at my local Minor injuries unit who just gave me painkillers. But in the last year or so i've had about 3 episodes of excruciating neck/shoulder pain in the same area as i had checked out. This usually needs a trip to minor injuries and some very strong painkillers to sort it.
I'm now becoming increasingly worried that this is going to keep happening and whilst i don't want to claim, i'm very aware of missing days at work with this. I also understand you only have 3 years to claim after an accident.
Can anyone advise me about this.

Andyrory, should you think that this is directly as a result of the accident, then yes, the statute of limitations is three years - but it's three years either from the date of the accident, OR from when you first became aware of the condition.
If you want to pursue this, or take proper legal advice - contact your insurance company if you have legal advice cover with the motor policy which was in force at the time of the accident. When we had an accident claim, the legal company helped us through the personal injury claim process. I would contact them now, just to see what their stance on this is.
^ for the other part of your question, probably not - 50/50 means the costs were split, your company pay yours, his company pay his. Nobody actually sees any money.
As your Loss was Lower thanyourexcess you should receive 50% of your loss from the Third Party insurer and your insurer should pay 50% to the Third Party or their insurer. But you will both have your No Claims Bonus affected
