Neighbor Has Built A Wall Between Our Front Garden.

We havea shared front garden with shared gate access .My neighbor has built a wall between our front garden.It has restricted my gate access.I told him he was responsible to the work on my side to extend my gate access aswell.He says he is not responsible as "that wall is your property and he can't touch it".I told him a friend of mine did the same and had to pay for works on his neighbours side.My neighbour said "only applies if it was in writing" Who is right ? Also both are private properties , so will the council get involved ?

Thanks ,so basically i have to take him to court ?
my view is yes and..... this is ( or can be - extremely expensive)
we got thro £10 000 no probs and settled out of court

Ok.Does the neighbour need planning permission under Party Wall Act or other legislation?
Planning law has nothing to do with private property rights or with Party Wall legislation. Planning seeks to protect the common good, not to attempt to usurp other legal frameworks.

Ok thanks.I think my neighbour was annoyed when i had external insulation wall done -and didnt inform him of it.To be fair he never caused any issues.However , he did inform me of his Party wall but has reneged on what he said - but besides his word against mine.He has never been an awkward neighbour and its probably best to pay for my side to maintain neighbour relations rather than escalating matters

Atheist.My wife has got annoyed by their "attitude"- she's more outspoken than me , but she said just leave it.I know there is a principle involved but its not worth the hassle for about a £100 worth of work
tali; if it's important to you (e.g. because you would lose access to off-street parking) then you might want to pursue it. Are there no clauses in your purchase documents which spell out what can and can't be done? I would expect that your solicitor at the time would have spelt out any worries or questions.
If it's just £100 I wouldn't bother, unless that £100 quid was really important to me and I was going to suffer real loss.

Atheist, If the council could get involved i would pursue it -as that would be easiest way.Getting solicitors involved over a small amount is not worth the aggro it seems
tali. in my view it's nothing to do with the Council. You could ask them, just to make sure - better to ask them rather than Answer Bank.
He was wrong to do the work unilaterally and restricting your access. It would probably cost a lot of money to prosecute him so an easy solution would be to put a new gate in your side for your use.
Have a word with Putin. Missile department. :)
