Cigarette Smoke From Other Flats

Upstairs flat complain about cigarette smoke drifting up from flat below. There is nothing in the covenant/lease/law that says smoking is banned in individual properties. Could easily go outside and stand outside smoking, it would still blow up into upstairs window if open (it happens to me). We are talking about 15 cigarettes a WEEK. Upstairs noise is a nuisance to me everyday, but I never complained (being woken up several times a week in the middle of the night). Your thoughts please.

the smell of cigarette smoke is the most vile smell i know especially for someone who does not smoke.
Well don't suffer in silence is my advice. Sometimes you want peace and harmony but the moron from upstairs obviously wants a war so start recording,complaining and logging in times of noise and present to the noise abatement team,landlord and police to show him that as friendly as you are you can fight fire with fire.
Tell them to stand outside. The smoke wont drift down.

Do you think if you went to see them upstairs and promised to stop blowing your smoke in their windows (15 a week, why bother?) they might agree to not waking you up several times a week in the middle of the night?
It sounds as though your upstairs neighbors might have nothing upstairs.
The thing about living in a flat that many people don't realise until they move in , is how much closer you are to your neighbours and how everything you do may impinge on them.

At the moment we are a very happy and cooperative group in my block and all get along - in the past I have had neighbours upstairs who thought I was imagining hearing heels stomping all day on laminate floors , one guy who threatened to destroy my machine because he could hear it at 3pm in the afternoon - the list goes on.

Try to come to some agreement between yourselves if the other neighbour is willing to do so.
I live in a semi and between two neighbours husband and wife who smoke at least 15 a day each - they don't sleep - I'd say between them about 3 hours sleep - so much has happened to them that they never relax - they stand outside and the smoke comes wafting into me on a daily basis. I do hate it but there is nothing you can do or say as they are on their own property.
