out of date milkshake

xmas eve me and my fiancee went out to finish off the shopping at the local town. 1 of the items purchased were yazoo chocolate milkshakes. xmas day our son was ill and was being sick, we checked the food he ate and everything was fine but noticed the date on the milkshakes said 26/11/2011.
i rang the store earlier today and was told by the manager "milkshake is ok for a month after its use by date" does anyone know if this is correct??

i argued with the manager saying its dairy products and are now awaiting the call next week off the area manager.

also, is there anywhere else to report this as i still have the milkshake and receipt.

Trading Standards would be a good place to start - but I've drunk Yazoo Milkshakes that are a couple of weeks out of date, as long as the milk hasn't gone off and they are sealed, they are fine. However, while the shop manager could be right, he should take the stuff off sale if it's past it's sell by (as distinct from use by) date.

cheers, i have no idea if it has actually gone off but i thought all dairy products needed to be used by the date.
i was sold this 4 weeks after the sale date on the packet
Sounds like the shop has a problem with its stock control - nothing (under current rules) should be on sale past the sell-by date.

As for use-by dates for dairy - why? - I regularly eat yogurt which is a month past the use-by date - as long as it's sealed and in the fridge it's fine. We take very little notice of use-by dates in our house, if the cat'll eat it, so will we.
Is Yazoo the one that is sold next to the long-life milk? Personally I don't eat or drink anything a day over the sell by date let alone a month! Do as boxtops suggests and try Trading Standards. They are really helpfull and remember to take the names of who you speak to. Good luck with it and I hope your son is a bit better
The 'use by' date is flexible. But the 'sell by' is not.....if 'sell by' was 26/11/2011-it should have been removed-and that is the responsibility of the shop owner/manager.
Exactly pasta - then it's up to the consumer when they want to use it. It's the sell-by date which is wrong in this instance, the shopkeeper should have taken it off sale.

the milkshakes were refrigerated at home, but were on the shelf at the store in a pack of 3.
Makes no odds, neil - they shouldn't have been on sale a month after the "take off shelf" date. I always buy my stuff in date, it just takes me a while to get round to using it.

i sometimes look at dates on stuff but on these milkshakes they have usually gone in a day so i trust the shop to do their stock control.
...as I would - it's the shopkeeper's duty to rotate his stock.
Was this a major supermarket chain-or a corner shop? Either way-the manager is in trouble if you pursue this-as you should.

its a big high street chain store, not gonna mention who yet has i will post the name after the outcome along with the outcome
I would not use anything with an out of date 'use by' date but if it is a 'best before' date it should be all right for some time after. Some of these dates are ridiculous - as for instance on tins.
I think you'll find if you loook that Yazoo is steralised milk and is good for at least 6 months.. Speaking as a grandmother who is very familiar with the milkshake section of supermarkets...Constantly on the lookout for Fridji 2for1 deals..Also the winter vomiting bug is going around so it may just be that.
