I have been married 10 years. Been together 17 years. I was his 4th wife (cheated on all of his wives and even had a child via an affair who he has nothing to do with).
9 months ago he confessed for the second time of cheating on me and this time he was leaving me for her. I packed his bags! He left with his bin bags on the Saturday , but unfortunately Monday he was back but no bin bags! Since then he has stayed at his mistresses at the weekends, returning on the Monday after work. I told him to stay away from the house but he refuses. He did stay away at Christmas as I had family over. Apparently this affair has been going on over 2 years, 18 month ago she left her husband for him and now is in a rented house. I asked why he just doesn't go and be with her, he says it not that easy. Why, I don't know. There are no children involved. I have filed for divorce under unreasonable behavior as he refused to acknowledge the divorce on adultery. I gave him a letter with what I thought was a reasonable divorce settlement, we could start on, he refused to talk about it. I am now going through a solicitor and the £'s are adding up! He refuses to discuss anything. He seems quite content with living with her at weekends and in the marital home in the week. The house is jointly owned so I cannot legally throw him out. I do no cooking, cleaning or anything for him and avoid him as much as possible. I cannot afford to leave and rent somewhere. I desperately want to get the house sold, split finances and move on. It is now making me ill and depressed and I just don't know what to do. I work but don't earn enough to support myself. He works and has a good pension, the idea was we would retire in a few years, downsize and enjoy life but that has now been snatched away. He is 57 I am just 60.

You can apply to the court for an order of 'division and sale' which will allow you to go ahead and sell the property, dividing the proceeds between you.
As no children are living at the property that shouldn't be a problem. You can apply to the County Court yourself, it should be straightforward but as you are paying a solicitor I'm surprised you haven't been made aware of this course of action.

I had no idea. I thought we had to be seen as trying to mediate before the court can get involved.
Once a cheater, always a cheater I'm afraid. I do hope you can sort things out so you feel better.

What an awful situation for you, you must speak to the solicitor about how to go about selling the house, and achieving a financial settlement which is much more important than the divorce at the moment, although it would be good to have that too.
Just an update: Still no further forward, waiting for him to give his finances to his solicitor, despite several chases. I told him it will go to court unless he gets unless he gets his papers to his solicitor asap. He has said he will, so lets just see ......
