When my ex and I split up (we were not married) i gave him PR. After 3 years of me sorting my life out and getting married to a great man, my ex has now started threatening fighting for custody for our son. Now he attempted commiting suicide about 1 and 1/2 year ago, and his present g/friend has aswell, they live together in a small place, he is now unemployed, after giving up his job. What chances does he have of it even getting into court?

What is PR Hayhop? Parental Rights? Anyway, it doesn't look like he stands a cat's chance in the hot place of getting to court, if you ask me. Don't worry and be strong!
You dont say how old you're child is. If they are a reasonable age, their views of where they want to live will be taken into account. Based on the info supplied it is obvious your ex could not offer a stable and settled home life so at the present time i would not think he would get custody.Having said that,unless your ex has been a bad father let him have as much contact as possible with your child. Kids need both loving mums and dads even if they do not live together.
None. A Judge will always look at what circumstances are best for the child. I'm a step dad in a similar situation. My partner sometimes worries her ex, who has access, may go for custody one day and though it's clear he loves his son, I KNOW we provide a much more stable environment. Try not to worry.
