Can someone go behind your back and give your father's shares to someone else if they are not on the will and you are

the executor(s) are legally obliged to distibute the estate according to the deceased's wishes - my 2 cents.

More information needed.  Does they Will specify that you are to inherit the shares?  Is it the executor that has given them to somebody else? 

The shares are not in the will.  The OP said so - although he hasn't said who has given them to someone else.

 

I read it that the person is not mentioned in the will but the OP is.

 

Oh, I read it that the shares weren't mentioned.  The OP must mean the person receiving the shares isn't mentioned in the will.  

Some Companies ha Articles of Association, there may be stipulations in them that dictate what can happen to the shares. This would override the Will. An Example would be that they have to be divided between the other shareholders.
