It's mortgaged and the mortgage expired this month? With a balance outstanding can I seek the flat and buy somewhere else with my equity ?

What?

Do you mean you are living elsewhere and renting your flat to a tenant?

If you're renting your flat out to a tenant, and the buy-to-let mortgage has now expired, you can either sell it with a sitting tenant or evict the tenant and then offer it on the market.

I think you need to repost/reply with a clearer summary of the situation and your question.

Do you mean you own the and have paid the mortgage except for an outstanding balance; and you have a tenant in their who pays ren  and you want to SELL (not seek) the flat?
