My hamster has a enlarged hip on one side and the hips look slightly out of sink in appearance, I was he stuck in one of his tubes the other night in his rotastack cage where he had blocked himself in a tube with wood shavings and was struggling to get out, so I helped him. Since then I have noticed his hip he is walking and seems completely happy in himself. I know when he is unhappy because since I got him 2 years ago he will scream if he doesn't like something, for example if you have woken him up, or he has food stuck on the bars of his cage. So he is good at voicing himself.

So well I am concerned about taking him to the vets because all of them near me seem bad, and I know they will want to treat him even though he is fine, and in the process will kill him or leave him in pain, like they have other pets I have taken in.

I have put him in a big square cage and not his rotastack so he is not putting strain on the hip or making it worse in anyway, and just keeping an eye on him, I feel it is wrong to leave him like that, but he seems to be enjoying life still and he wouldn't be in my view if I took him to the vet. I know if I was to take him and disagreed about their treatment and left without treatment they would think I am a bad owner and report me to the rspca.

I think you ought to take him to the vets to get him checked over. Even if he isn't 'voicing himself' he could still be in some pain.
He might just need some pain killers and anti inflammatories. If your worried they will give unnecessary treatment I think this unlikely as vets will only give anaesthetic on an animal this small if there are no other options.
Ask around your friends with pets to get a recommendation of a good local vet.
Hope he gets better soon
