so two separate questions. your second question is duplicated elsewhere . regarding the sex would the wife want him to be charged. if so report to police
No expert but it sounds more like persuasion to me. If one doesn't like the situation maybe one should consider if they are in the right marriage.

I have just read a book called 'Why does he do that' by Lundy Bancroft and he would very definitely define that as rape yes. However a Judge may see it differently. Whether asking for yourself or a friend I'd recommend the book and also second what 'Old Geezer' said on the issue perhaps one needs to look at the relationship and whether it's working?
