Hate to say this, but I can see a good lawyer getting this down to 'Death by Dangerous Driving' or similar.
Do they know which of the 2 was driving? I think one was 18 while the other was 30. If the youngster was driving it could make it easier for a jury to believe it was an accident due to lack of driving experience.

I am increasingly thinking that it will be impossible to prove deliberate intent - the only witness will be the accompanying officer, who was too busy diving out of the way to give an objective account of what happened.
