my partner went out last sunday to watch the football with 3 of his friends, he said he was in the put and there was a big lad about 6ft tall. (much taller than my bf) he started picking at my partner - my partner said he was trying to put his elbow in in face and generally just trying to wind him up..he ignored him for a while and then my partners mate ended up knocking him out unconcious on the floor. then stupidly my partner went over to him and punched him (whilst unconscious ) 5 times in the head. he then left the man an ran away, later that night he got arrested for GBH with intent- as the man had a fractured eye cheek bone and cracked jaw plus stitches to his eye and chin. he has to go back to the police station soon to anser his bail and then i think it will goto court. im just wondering if he will get sent to jail for this? Please can anyone help?

methyl, courts in England do have a 'plea bargain' though I do not know if it is called that. A court will sometimes accept a guilty plea in exchange for a lower level charge. For example accept a guilty plea to ABH for a reduction of the charge from GBH. I do not think it could apply in this case as it looks like a clear case of GBH section 18 ( the victim was knocked to the ground first and then punched in the head 5 times) . It is normally to avoid the cost / time of a trial where the evidence less positive.

no he hasnt been charged with it yet when he got arrested he got let out on bail till may, on his letter that hee brought home says GBH with intent and he has to answer his baik in may, i expect this will then got to court and trail? thanks everyone

i never said once GBH is like a punch to the nose at all, im asking for a bit of advice thank you if you havent anything good to say the please dont reply! !
