The Executors nominated will get probate and carry out the deceased's wishes.
You've left me confused. If someone makes a will then (obviously) the executors carry out the instructions in that will.

If the will leaves something to a child of the testator, but that child pre-deceases him/her, then the bequest goes to the children of the intended beneficiary.

If the will leaves something to someone else who has pre-deceased the beneficiary (or to a child of the beneficiary who did not have their own children) then the bequest goes to the 'residuary beneficiary' if the will names one. Otherwise that bequest is treated as 'partial intestacy' and distributed according the rules of intestacy. (see below).

If there is no will then the intestacy rules apply to the whole estate:

Ubasses answer assumes that there is someone who knows that the will exists or it is left where it will be easily found, also that executor(s) have been nominated in the will.
If no will is known to exist then, of course, the estate will be distributed according to the intestacy rules.

If there are no executors (perhaps because they've pre-deceased the testator), but a valid will still exists, a court can appoint suitable executors.

then when he dies you follow what the will says....

but if the will is hidden or stuffed down the sofa then the intestacy rules are followed as tho there isnt a will

The will should nominate executors, and it is bad form to name an executor and not tell the fella. But you could. The executor can then say 'no thanks'.

In carrying out the terms of the will, the family and close friends have no function UNLESS they are named in the will as an executor.

If there are no family or close friends chances are they have used a professional who will hold the Will and a copy is in the house. If they made a DIY the original could be in the house. As Peter Pedant already said, the Executors should have been asked and will have been told where to find it.
