Is It Illegal To Not Work Or Study When You Have A Work/study Visa

My sisters boyf came here from Nigeria to study and work and was doing so up until a year ago when my sister fell pregnant! They have decided that she will go back to work and he will look after the baby! Can he do this? If he is here to work/study is it illegal if he is not doing both even if he is a dad?

Of course it is illegal.

He is a freeloader, living off your sister and the country.

Next he will be asking to marry her so he will have a right to stay in the UK permanently.

Sounds like he's heading for permanent residency.
We have told you before , your sisters boyfriend is here illegally. He claimed to be a Biochemist to get a work visa but was working as a security guard, that is illegal , he HAS to work in the job specified in the visa and you can not get a visa to be a security guard they are only highly specialised jobs ( such as a Biochemist)
He HAS to work and it MUST be in the area specified in his visa. This man has deliberately targeted your sister and got her pregnant to use that as a way to stay in the UK. His next move will be to claim asylum in the UK by claiming his 'right to family life' under the human rights act.
At the moment your sister is committing an offence by harbouring him , she needs to throw him out and report him to the police as an illegal immigrant .
Hard I know, but the longer he stays in her house the worse the situation will become.

Sadly your sister has probably already made it difficult for the government to get him out of the country.

Even if he is here illegally, he now has a child here so, as has been said, he will claim he has a family life so cant be sent home.

He will probably spend years fighting his case, using up thousands in legal fees (which we will pay for) and of course eventually will be allowed to stay.

So we will have another "waste of space" in this country who will probably live on benefits (or crime, or both) for the rest his life.

There is a chance it's a legitimate relationship.
He's done something a contortionist would be proud to achieve. He's got his leg over and his feet firmly under the table(the UK table, that is) at one and the same time.

The guy was on a dating site, he got her pregnant right away and moved in.
He 'does not bother with her family' and will not let her go out with the baby.
He has told the sister he will not work so she has to leave the child with him and go back to work to keep him! Yes it may be a 'real relationship' but if it is I expect to see squadron of pigs fly past my window !
We only know a very limited side of the story.
Baldrick, He had a work visa, but work visa's are ONLY valid for highly skilled jobs where there is a shortage of UK residents to fill them. He was working as a security guard when he claimed to be a graduate biochemist. His visa is ONLY valid for work in the area specified (biochemistry) so he is proved to be illegal as he was not working in the job his vias specified. You CAN NOT come over on a work visa and do an unskilled job like a security guard. Who ever employed him is in trouble as well.
As Luckytime has already been given answers to the Legal Position of her sister's boyfriend, perhaps it would be best to lay off the personal opinion regarding her sister's conduct?

Thanks Eddie, I had read the previous OP and am aware of the limited facts given, including use of Work Visas, so not sure why you're telling it again.
