Iphone 5 Not Working Still Under Warranty

my daughter has had her iphone 5 for 10 months and it has stopped working properly. it turns itself on and off and sometimes a blue screen.She took it back to the shop as it has a twelve month warranty. she is on a 2 year contract. the assistant said it was in fair condition, normal surface scratches and nicks but nothing major, just wear and tear. the shop sent it off and my daughter got a text to say it was a category "4" which they said was poor condition and want £190.00 to fix it. As the phone has worked for 10 months, then I don't think surface scratches are to blame, there must be something internally going wrong. no explanation was given as to what was wrong with it, just £190.00 to repair. she has not got that sort of money and she still has 14 months left on her contract which means she will be paying for a phone she cannot use properly. Any thoughts on this would be welcome as we don't know what to do. we have to collect the phone back from the shop next week

What are the warranty terms?

Is a warranty from Apple or from the phone company?

Do you have a Apple Store nearby - if so book an appointment at the Genius Bar and see what they say.

thanks tuvok, will check with her about the warranty and see who it is with. I will read all the small print when I get my hands on it
firstly, I would be taking the phone to an apple store and no other shop because you run the risk of voiding the warranty, as I understand it only apple can repair there products without this risk. secondly, I used to work in the mobile business, as i understand it if you are in a contract for say 12,24 months your phone remains in warranty for the duration of the contract though this may be different with iPhones.
Her contract is with the shop she bought it from, not Apple.

What hc4361 means is that your contract of purchase is with the vendor, so they are responsible for its repair. This is not the same as your service contract.

thank you all for responding and your very useful information. now when we take it back we are armed with arguments we can put forward if they are not helpful.
