My father in law died recently and his will names his wife, my MiL, as executor. She has the early stages of Altzheimers and my wife and my wife's sister have a LPA over her financial affairs. Is it possible for the Attorneys ( my wife and SiL) to apply for probate on MiL's behalf or will it have to go to court?

When you say Attorneys did you mean to say Executors, Graham?

Factor. I meant, could my wife and her sister, as Attorneys named on their mother's LPA, apply for probate and act as executors on her behalf.

Buenchico. As the MiL is in the early stages of Altzheimers it seems Section C. would apply and she can give permission to the Probate office for her Attorneys to apply for probate on her behalf.

Sorry Graham- I now realise you mean you have Power of Attorney for your MIL. I mistakenly thought you were referring to yourself as attorneys (meaning executor) for your FIL
