Hi just a short detail of my problem, 1st, eyes tested on 27th Sept 2012, glasses not ready untill 12 October collected during the trying on of them I told them that they were not mine and that I could not see with them, the assistant told me yes they were during this process when they attempted to clean the lenses one lense fell out, I was very irrate at this time, they told me that the glasses would be repared, I told them not to worry because they were not mine anyway, they still insisted that yes they were, I walked out angry and upset. Unfortunatly my partner of 32 years passed away on the 26th October so I did not do anything about these glasses untill the 5 November when I went back into the shop to see if the said broken pair of glasses were back repaired, yes they were but nobody had bothered to inform me. I was asked to put them on which I did, but told them I could not see out of them, I was given another eye test which showed that the said glasses were the wrong prescription, so the optician said that they would get another pair made up for me with the correct prescription and told it would take 10 to 14 days, I visited the shop today as it has been 16 days, the glasses are not ready so I asked for my £306.00 back but was told they do not refund, so my question is what rights do I have in this situation. thankyou in advance WHF

They say they will not do refund, if they can get away with it. The Sale of Goods Act 1979 clearly states that products should be of a "merchandisable quality", which in your case means you should be able to see through them. As they are not, you are entitled to a refund.
I was not satisfied with glasses prescribed for me, so after weeks of them being adjusted(assistant bent the frames to do this) I asked for my money back, back of receipt said this could be done upto 3 months . I went to different optician and got much better service.
