unadopted road

I am trying to get planning permission to change from industrial to residential.It's a small site in an unadopted road where there are already 8 terr est houses. The road is in a poor state of repair. The Transport & highways state a maximum of 5 houses can be served by a private/ unadopted road. Their regs are already being breached, so why are they insisting that I alone would need to include the road repair in my plans?

Have you still not got yourself proper legal advice. based on land searches, etc. in your area ?
Very likely because they are short of money and this sort of thing has increasingly become the norm - the developer pays for the infrastructure. No doubt the existing houses were established quite a while back ?

Yes the houses are old that are already there. What do I search the land for ?
You get yourself a Solicitor who will be able to 'search' land records which will, hopefully, answer your questions about current/past ownership of land and property and any covenants or other information which may have an impact on your proposals.
i think that if the council are making it a stipulation for you to get planning permission, you are just going to have to swallow it and pay for it i'm afraid
I have a distinctly strong feeling of deja vue reading this - pretty damn sure I've answered this once before.

When you are a developer, the planning authority can ask for whatever it wishes (within reason) as a condition for granting planning consent. This is the condition they require from you.
Look at it this way - you make a shed-load of money from the development gain on the land - less the modest cost of the road; they benefit from getting a bright shiny spanking brand new road at your expense, for the benefit of the community at large.
Please show me where you reckon 'the Transport & highways state a maximum of 5 houses can be served by a private/ unadopted road'. This is hogwash (a technical term).
