council court whilst benefits rectify...

Can the local council take a person to court for non payment of CT even though the person does not owe it and the DWP are taking a long time to sort their mess up.ie they suspended IS because the computer automatically did this due to the recipeint receiving a higher rate of DLA after DWP doctor inspection, and the DWP did not inform the person of their action.

Thanks for reply, what has happened is that DWP after suspending the IS immediately informed council that recipient no longer got IS. DWP found that recipient had been examined and qualify for higher rate of DLA, then apparently the computer automatically stops IS because of this. Apparently DWP have no obligation to tell recipient what they did. Though they find it easy to tell the council . The council have been informed that the dwp are 'sorting the mess' however, the dwp received several letters recorded delivery,which they have not bothered to acknowledge at all. It seems that they are quick to inform council, but could not care less about recipient.and the ensuing mess they create.Am I right in assuming that the council cannot take a person to court whilst their benefit is being 'sorted'?

I'm not so sure that they can't take you to Court. The important thing is to make sure that you keep in close contact with the Council and that they know exactly what the position is. You must also go on chasing DWP until they do sort it. If the Council become difficult, it could help to get your local Councillor involved, or see CAB.
