My last question obviously got pulled for too many swear words. Sorry

I have at last reached the end of my tether and given up trying to be nice to my tenants.

They have lied tooth and nail and delayed as much as they can knowing I am (desperately soft) too reasonable.

They were given copious amounts of chances to put this right. But they chose to just use my helpfulness to delay the inevitable and obviously save money by not paying the rent.

They have now made an accusation, via the local council housing department of harassment by my OH at her place of work.

For a start I don't even know where she works. She didn't even put employer details of the form she sent to the court for the CCJ and I have asked her for the details a number of times and she has refused to tell me.

OH has nothing to do with the property save for occasional maintenance but he hasn't even done that for two years as I get a man in to do it. He was unaware of her arrears or of the CCJ or that she had been served a section 8 or that I now Had a date to go to court to gain possession. I don't even know where either of them work and he certainly didn't know.

How in gods name do you answer or refute an accusation of harassment when none has happened and it is a blatant lie?

She is obviously trying to muddy the waters and will attempt to say we are unreasonable so either shouldn't be evicted or something or she shouldn't have to pay the rent she owes.

I know this is all my own fault for being to nice and reasonable (even in the face of her unreasonableness) but for gods sake, come on why?

Now she says she is going to defend the eviction ??? How can you defend a possession order for non payment of rent?

And is going for a redetermination of the CCJ.
Have you got legal representation??? There is a landlords support group who work with landlords in such situations...but have forgotten the name of the organisation. Please be fully aware that the magistrates/judges dealing with these issues will have seen and heard all the nonsense spouted by people who wish to live at the landlords expense before.....they are not too easily fooled. Good luck....

She obviously knows the system and you seem to have been far too 'nice' to her.
We have very few problems with our Tenants, on the odd occasion it has happened we give them little or no 'wriggle room' from Day 1.

The accusation of Harassment is probably a PIN noticce ?
if it is there is no appeal

there isnt even the idea of listening to the other side.

however you and OH should learn 'it is not harassment to ask for back payment of rent' - dont try "I am being harassed by being accused of harassment" - doesnt work.

They will try to get you to agree not to go within 50m of them
and be early to insist: "it is not possible in a legal case" -

I am just incandescent with rage right now. Of all the bloody lies, that I knew were lies but felt sorry for them, and this is what they do.

There is no way on the gods green earth either of us will accept any harassment notice because we and he in particular have not been guilty of harassment in any shape or form. We will not give her even an inch so if the police came knocking they will have to take him/us to court and prove their case which they will not be able to do.

Can you tell I have now, finally, after all this time and after all the trouble had enough.
Land lords have hat it to easy for years the DHSS money going strait in to the bank accounts and charging over price't rents for slums

You are talking out of your ***.

Generally speaking housing benefit does not get paid to the LL. it gets paid to the tenant and they choose whether to pay their rent or not. Sometimes they choose not to pay it.

Not all LL are slum LL. some are just ordinary people saving for their own retirement pension or as their only income who get shafted by a few scum tenants. Notice I didn't say all tenants are scum!! Notice how I am able to differentiate between good and bad tenants. You should try it with your opinion of Landlords.


Having both rented property to live in, and rented out property I own, during my lifetime, I figure I was the same wonderful individual in both situations.

Redvanman, I seriously object to your post @ 11:18, our Rentals are reasonably quality 3 bed Semis in decent areas, the Rents are probably a little lower than they could be, we try and stick to Ex-Service Tenants and we don't receive a penny of DHSS Money as you suggest.
cassa 333 you land lords had it to good for years till the DHSS started to pay the tenants the rent now you have to work to get the rents

Tenants need landlords and landlords need tenants.

Both are capable of being very good or very bad, as are all human beings. You kind of hope for karma where bad tenants find bad landlords, and good tenants find good landlords, but life isn't like that. The bad tend to take advantage of the good.

no take it from a landlord (!) this is now not the rule

HBD has morphed into LHA which is paid to the tenant and is intended to facilitate and inculcate principles of house keepting
What is not trumpeted is that about 50% of leases paid for by LHA end up in eviction for non payment of rent - see above

I for one am not coming out of the woodwork, I have never made a secret of being a Landlord, if you don't know what's posted on Site due to you sticking to posting on Music Threads I cannot take the blame for that.
No one would take a lease on a slum.
