I am giving my notice in tomorrow to my present employer. I do not need to work any notice period, as I have never been given a contract.
I am leaving because of the stress it causes me.
If they ask me to work a notice period, I do not really want too and feel I need to have some answers ready!
Could you please help me with this? Many thanks in advance.

Tell them the truth, what do you have to lose? ...your job, win win :-)
I am afraid that things are not that simple. If you accepted the job and have started work, you are deemed to have accepted the contract.
Have a look at the ACAS site.
Do you have another job ready to go to?

Tell them to show you in your contract ( that they never gave you ) where it say's that you have to work a notice period.
Well, the simple answer is that you reply to any request with the fact that you do not have a contract. They can get rid of you without notice and you can equally leave without notice. Sauce for the goose etc.. Tell them that you are leaving because of the stress they cause you and have examples ready to hand. They may come back and offer you better terms and a contract, so have your terms ready. Good luck.
If you are in the UK, by accepting the offer of employment there is a contract even if you have not been given a written copy. If you have been employed for at least a month, in the absence of a contractual notice period, the minimum statutory notice period to give your employer is a week.

Have you ever been paid annual leave or sick leave in this employment?
I always used a sickdea relative......I can't because -my grandmother died (not a lie...she had died years ago) - My aunts funeral...in some distant place....she had died some months before..... I never lied but did use some historical situations ...... Serious family issues that I have to go and help with...... cat wasnt well..you get the idea.....
Tell your boss you have Ebola.
Work your notice, as you might need a reference from them.

Your stress level to do with your job will drop once you have resigned anyway.
There is statutory notice and contractual notice, whether or not you have a contract. If you want a reference, and I would strongly recommend that you do, I would hand your notice in, work the statutory notice and leave with good grace no matter how you feel.
>"They can get rid of you without notice "

That needs clarifying, Jourdain. Yes, they can tell you to leave immediately, but they have to pay for the notice period.

Strictly speaking scruffbag should give notice but i doubt they would take him to court for breach of contract- however they may be tempted to say in any reference that you you walked out without notice. They may agree to waive/reduce the notice period though- it may be in everyone's interest
