So here's the deal:
2 people married for a few years, both pensioners and both have a small private pension.
When they met, he had nothing and she had her own house, paid for, in her name. After a while together, they get married (house stays registered in her name).
My question is, if they were to separate, would he have a claim on the house??
I'm getting conflicting information on this.
If it makes any difference, all children are grown up and have got their own home, etc. All bills have been shared, as they have a joint account where all their moneys goes in.
Any advice please??

I think the answer is 'Yes' but not certain.
Yes, unless she made a pre-nuptial
one is gonna say - there has been a merging of assets and so i want half please

and the other will say - you have not contributed in money or kind to any of the house and so off you go onto the street if necessary

and I have to say I await the opinion of Barmaid as to which one wins
sorry

No pre-nuptial made.
She's thinking of transferring the house into all her childrens' names - would this be allowed, or would he still have a claim??
Everything at the mo is rosy, she's just thinking ahead, in case things change.
Is the house in England, Wales, Scotland or NI?
Question Author
Soz forgot to say that it's in England ;)
No, transferring to children probably will not work. I knew someone who did just that, the judge said that they had only done it to deprive themself of assets and awarded a large percentage to the ex wife.
ubasses point

if she is thinking of transfer - then she recognises that she has a claim against her. game over really

[which would give the basis of ubasses' opinion that the judge fingered the transferor]

so the quezzie really is: two people who once loved each other now dont and it is possible for one to screw the other well and truly ? - sort of nailing to the wall job

and you will get opinions - hmm difficult along with
yeah I did it once and it was the best thing I eva did.....
