Last October my husband had a bump in the car. We informed his insurance and sorted all the paperwork etc. Out of the blue 2 weeks ago he received a letter telling him he will receive a summons to appear in court regarding the accident. We are in our late 70s and have never ever had this sort of experience before. We sent the letter to the insurance company and not hearing from them he phoned them after a week to ask what was happening . He was assured that everything was paid and settled. This morning he received a summons to appear in court. (The insurance states free legal advice). We really really do not want to go to court. Please someone give us advice.

From your wording (“served on the 8 March.”) that would appear to be the date on which the papers were served to you!!! (that’s why I said “they were served next Tuesday”). There should be a date on which any court hearing is to take place and that should give you a decent amount of time to get your information together. It would certainly not be just a...

There are fake solicitors who are part of the scam. I have had letters from them.The point is that a solicitor would not try to get cash direct from you direct nor ask for bank details they would go straight to your insurer with the claim.No phone numbers on the form is also very dodgy.

I am not sure it's a scam. it just sounds like the sort of letter you get from aggressive accident solicitors. They write to you and you pass it on to your insurance company who are acting on your behalf
Surely the letter from the solicitor had his telephone number on the headed paper he used.

Thanks for all your input. Things are getting sorted now. Rang the court and got advice on what to do. No hearing yet. The insurance are dealing with it all. It appears it has been paid but this came into the mix before things were fully sorted. Have been having step by step updates from the insurance company. What a huge relief. Thank you all.

I think if you have learnt anthing
it is to open a ( legal ) letter and read it carefully.....

and a lot of this steam with no light would have been avoided

Getting such a document through the post does cause anxiety to those who haven't experience of such things. It is a shame lackie received it on a Saturday when the insurance company and the court was not available to advise until Monday
