A quick question on buying a freehold...

What would the situation be if you were buying the ground-floor flat of a council property, but the council were still renting the top two floors? Can the Freehold be purchased?

I seem to recall being told that ground floor flats are treated differently in this respect - that could be nonsense of course.

I am not an expert. But why you wanted to buy freehold? Surely you are asking for more trouble from the flats above. You might be responsible for up keeping the whole building. You need to check out what responsibility you have when you owned the ground.

That's a good point. I thought that was the case anyway, that as a leaseholder you still had to contribute to whole building repairs?

It's entirely up to the Council whether they would sell you the Freehold of the building. If not, you would be offered a Leasehold only.

In my experience, ground floor is not normally treated differently........

but .......... it will depend on the terms of the Management Agreement that would come with a Leasehold arrangement.

There is a legal framework covering the whole process. Although, details regarding leaseholders' obligations etc can be different every time. It just depends on what the conditions are in the Agreement.
