The article specifies an iPhone 6 being targeted and IOS 9.3.5 as the fix.

Are users who cannot upgrade IOS, due to equipment limitations, left vulnerable or is old kit protected by virtue of not being sophisticated enough to make the hack work?

The article is written as if everyone and their dog was up to iPhone 6 (even though 8 out of 10 mobile users are on Android devices, in any case).

Thanks. IOS upgrades are a bind, having to unload a bunch of stuff to make room for the install but I guess this is worth it.

Anyone so budget-strapped as to be on anything earlier than 4S can't be up to much, in any event and thus not worried about anyone spying on them.
