hi just after some advice

I have a restraining order which is to protect my ex (long story but was easiest option) but we also have a family court order in place
both state that my mum is 3rd party as we cannot have any contact get my mum has stepped down as she is fed up of all the crap she got from him about things other to do with the children,
my ex has made an application to vary the restraining order, iv been summoned back to magistrates court, letter didn't say why so I rung them and they said my ex has told them about my mum not being 3rd party now but that was it, so I'm assuming it's to find another suitable 3rd party but there is no one. why does it need to go through the magistrates court if it's to do with the children I though it would of needed to go back to family court? the restraining order is in place for us not the children,
any advice or help would be great, I'm not worrying as iv done nothing wrong but I do have my solicitor ringing me Monday morning x

The court needs to know the new '3rd party' and that person needs to agree the contact details with the court. The family court and the family court work together on these cases, the family court is normally part of the magistrates court.

there is no one else that can be 3rd party this is the problem we now have
Then you will have to get the restraining order modified to allow contact to hand over the child for the access.
In some places there are 'Children's Centers' run by social services if there is one near you it may be possible to use them as the 3rd party. The court will know what is the best way to proceed.
