Yes, I agree Bathy. There have been far too many paedophiles allowed to die before justice can be brought. Lets hope this is the first of many such cases.

It must be awful for victims to see people getting away with crimes, time and time again. Have we learned nothing from Savile ?
I don't understand this "trial of the facts" business. If he's unfit to give evidence, how exactly are the facts to be determined? Any idea what the phrase means?
Good news if only for the other people it will expose who were complicit in the circumstances.

jno...to be honest, I'm not sure. Its a legal procedure that isn't used very often I think. Perhaps New Judge can enlighten us ?

By the way, I am not denying that Janner has some kind of dementia. But Alison Saunders was too quick to act in April.

Ummm.....I am not sure if Janner could pretend to have Alzheimers, under a close examination by Doctors. But again, we need an expert opinion on this...perhaps Sqad can help ?
I'd say it's pretty hard to fake. I'm not sure how someone can stand trial for crimes they may or may not have committed and may or may not remember if they did or not.
I've no proof, but we've all seen people playing the "unfit to plead" card and living a full and happy life after getting off.

Solicitors keep a list of expert witnesses and choose one who can be relied on to say the right thing. He has the money to buy the best.

by the usual means - other people's evidence

the reason why no one knows what is going on, is that there has been a victim review and it is the first time that a decision of the DPP has been overturned using this procedure

wow I can tell you the system isnt meant to work like this ! victim review was just meant to be a cuddly talking shop - "there there it really IS for the best... etc "

It wouldn't be difficult to fake for a diagnosis. It only involves a few questions. Whether you could keep it up without anybody else noticing is a different matter.
thanks for the answer, PP, but is other people's evidence enough to determine facts? Heaven forbid that any of us should face such a trial in our dotage and be unable to rebut any of the supposed facts put forward.
Saunders has poisoned the well for all really ill people. But a look at Janner's medical record ought to demonstrate if he's been ill a long time or if it just started last week.

Yeah I think you are thinking about Ernest Saunders and the Guinness trial which was around twenty years ago

He was let out on a/c of dementia and er lived and they changed the diagnosis to pseudo dementia secondary to depression


Quite a lot of comment on that in the medical press as a result clearly mad people were being convicted and sent off to prision and everyone was now less willing to listen to forensic psychiatrists

It appears that Janner will face a complete "real" trial, not a "trial of the facts"

And yes, I think Alison Saunders should now tender her resignation. Its the very least she can do after this shambles.
