I think if the bike driver was doing 97 miles per hour he paid a VERY large part in causing the "accident".
It could be argued that if the bike was doing 97 mph then the car driver probably could not see the bike before it was on him. A bike doing 97 mph travels a mile in about 45 seconds.
In fact a lot of blame should be placed on the shoulder of the bike driver, even if he is now dead, as driving at that stupid speed he could well have caused a major crash killing a number of people not just himself.
Why do some bike riders feel justified in going so fast and causing these accidents.

he's not in jail because the charge was not "death by dangerous driving" as reported, but "death by careless driving". at the inquest it was stated the car driver would have had sight of the bike for 7 seconds before the collision, given his speed. in turning in front of the bike, the driver may have assumed he could beat it if it were travelling at 60, but the police adjudged this "risky" regardless, and the successful prosecution bears that out.
^^ Yes death by careless driving is a possible jail sentence but only if the level of carelessness is very high. In this case the driver would not have expected the bike to be doing 100mph so he thought he had time to pull out safely. He 'had sight ' of the bike for 7 seconds, at 100 mph it would have been nearly 200 metres away when he first saw it, no wonder he though he had time to pull out.
Because the driver wasn't at fault. The biker was travelling at 97mph.

Car began the right turn maneuver roughly 3 seconds before impact, meaning decision was already taken to make the turn, meaning driver took the 4th second to assess clearance of both incoming lane AND desired destination.
4 seconds before impact, bike was 569 foot away or 173 meters. We can easily assume that during the 5th sec prior to impact, driver already knew he was about to turn right, so that put the bike 710 foot away (216 Meters).
The biker was filming his reckless driving presumably to load onto YouTube.
