Is it an offence to take a photograph from a car?

Police have shamed 80 drivers who took photographs of a crash on the M1.

Pictures of them appear in todays Daily Mail and the story says they have committed an offence by using a camera while driving.

It is the first time I have heard of that. Are they telling Porkies?

It may be offensive taking photos of an accident but there's no law against it.

If a passenger was to take a photo then nothing wrong has been done.

If the driver takes the photo then the driver's concentration will not be on the road.
