The important difference is that the first chap has not appealed to a court.
Border agency officials take decisions (as in this case) but they may be overturned on human rights grounds by a UK court or the the ECHU.
You get the feeling judges treat members of the EU differently to those from outside. Albania joined the EU in April 2009 so you would think the movement of labour across the EU would be allowed. Article 8 of the human rights should however be abolished for everybody due to its misuse.
theres a list of thingys (sorry appropriate word wont come) that include length of time spent in uk, strength of ties to the uk and other things (sorry cant remember them either its that long since i saw a rejection letter) but anyway it all goes on that when it goes through the Home Office, its a standard thing thats basically black and white, an appeal can be made against the decision
