I see that his former wife is to use the defence of ‘marital coercion’ as her defence in this case. Basically claiming that she did indeed pervert the course of justice (by taking her then husband’s speeding points), but was ‘pressured’ into doing it.
So later this year the High Court will have to decide whether to believe a spurned wife or a former government minister.
My money’s on the spurned wife.
Worth a bet would be that the court finds both guilty; not accepting her defence of coercion.
I believe that only in exceptional circumstances would someone found guilty of perverting the course of justice, escape a jail term.
According to Wikipedia, Jonathan Aitken is the only British cabinet minister ever to have been sent to jail – hopefully Mr. Huhne will soon be an addition to that list.
On another minor point of pedantry the matter is listed in Southwark Crown Court, not the High Court. Indictable criminal matters in England and Wales are always heard in Crown Courts unless they go to appeal.
