If you were doing an indicated 44 you are probably OK as your speedo almost certainly over reads.
The van gets you from the back, as I know to my cost as I was "got" last week :-(
and no, the van was not on the same side as me. It was across the road in a lay-by.
It doesn't matter what side of the road the van was on.....it can catch speeders on both sides of the road.....but at only 4 mph over you are unlikely to hear anything more about it.
If you are sure you were only travelling at 44 on a 40mph road you should be ok. Most speedometers read slightly fast. The ACPO ( Association of Chief Police Officers) policy is to allow ten percent over anyway.
