Car accident - whose fault?
Hi all,
Had a bit of a fender bender this morning, driving down a duel carriage way in the outside lane, when a white van who was stationery pulled out and smacked into me - he did not indicate.
He is now disputting that it was his error and will not pay for the damage to my car.
Am I at fault?

whether he indicated or not is irrelevant, he is definitely at fault not you.
If you had a witness, genuine or not it would help.

yes im afraid it is your fault , you were in a dual carriageway and yu should of let van out, its the law, lol no not really, the van driver is no doubt at fault he has obviousley not looked before pulling out into oncoming traffic, what you should of done is got witnesses and if he disputed fault at scene you should of got police , no car or van should of been moved and the scene left as iot was when accident happned, just report it to your insurance company as it happned

suggest to him , to may issue a county court summons against him ...... and of course you may pursue the claim , thru insurers ..... - diagrams of accident would assist , which ever procedures ,,,,,, you deploy, regarding the accident ...

And in your statement to your insurers replace all the 'of' with 'have' from the answer given above !!!!

Hi all, just an update, the guy made contact with me last night and is given me money for the repairs. Hubby took it quite well as well, and just said its not surprising he tried to run you off the the road look at what your driving!!!
