minimum wage

my step daughter is distraught at working as an apprentice at a hairdressing salon for a year and a half having signed their contract at the outset, but i think she is being paid under the legal minimum
@ 41hrs. per week for £85 clear. she is 19 yrs. old. can anyone shed some light please?

There are three levels of minimum wage, and the rates from 1 October 2009 are:

* £5.80 per hour for workers aged 22 years and older
* a development rate of £4.83 per hour for workers aged 18-21 inclusive
* £3.57 per hour for all workers under the age of 18, who are no longer of compulsory school age.
min. wage for a 19yr is £4. 83p
41 hours a week is too much anyway I think she should get a higher rate for the extra hour over 39, possibly. What are her contracted hours as opposed to the rota'd hours?
Apprentices under 19 years are not entitled to receive the National Minimum Wage.

Apprentices aged 19 and over, who are in the first year of an apprenticeship, are not entitled to receive the NMW.

As your step-daughter no longer seems to fall into either category, she is entitled to receive the NMW of £4.83 per hour. So her gross pay should be £198.03 per week, with take home pay of about £173.64.

PS: I've no idea what Dot is on about. Unless their contract specifies it, nobody is ever entitled to receive a higher hourly payment for 'overtime'. As long as their average pay, across a 13 week period, meets the NMW there is no automatic entitlement to ANY pay for overtime. (Junior doctors are only paid at one third of their standard rate when they work overtime).
I recieve time and a half for any hours worked over 40 a week, that was the same in my last job with the shoe company too,.
Can't agree with Dot. Dot's company might pay overtime after 40 hours but that is a matter for each company.
Have you checked her tax code and NI ? If she has had a job anywhere else before she might being taxed as if she is still earning from there.
