House occupied by father and partner.

My mother passed away in 2005 and left half the house to me as a Tennant in Common. My father now lives in the house and I have found out a lady is now living there with him.

Is there any action I can take to ensure that I will be able to get possession my part of the house should my father die. As far as I am aware my fathers half of the house is still willed to me but what would happen if he wills his half to her?

If he wills his half of the house to somebody else, you can either buy the other half; sell your half or try to come to an agreement that the house is sold and the profits divided equally.

As you are getting no immediate benefit from the house, and your father is, technically you could ask him to pay for rent - he is occupying your half of a house after all.

That is something for you to decide.
