Hi,
We bought a fridge freezer 5 weeks ago and paid it up fully. Long story short, it never arrived and on the day it was supposed to arrive I got a mouthful of abuse from the delivery driver, so I cancelled the order and was told that I would get a refund for the full amount £239.99. However checking my credit card today they have actually removed a further £2380 which has put us over our limit!!
We have spoken to the CC company and they are wiping the charges but to dispute the payment it all has to be done in writing.
So when I contact the Fridge company tomorrow can I demand compensation on top of the full refund of £ 2619.99?
Any help or advice of how to convey this to the company without losing my rag and calling them a bunch of thieving gits!

I refer to your last para - can yer man not phone them?
I suggest you contact the Credit Card Company again and ask them to invoke the chargeback procedure:-

Unless you have lost out in a material sense i can't see you getting any kind of discount.

What a shower of s h I t e. they are though.

Flonska the CC company is sending out a claim form so I am assuming that is what is mentioned in the chargeback scheme.
Wolf hubby is rubbish at these things but he will step in if needs be!

Oh Eccles they truly are!! Wouldn't mind but we are going on holiday on Sunday and the credit card is needed for the hotel bill etc!
the £2380 looks like a fat-finger bungle, doesn't it? They've tried to enter £239.99 again.
It does look like an error, as opposed to a deliberate attempt to defraud you - and obviously your CC company can see that.

Hopefully they can sort it out, since right appears to be on your side here.

well they were supposed to refund 239.99 and ended up taking 2380 so regardless if it was an accident or not - you would have thought that when balancing the till at end of the day they would have realised!!
I agree that it looks most likely to be an error and hopefully will be sorted with the retailer tomorrow. The only problem with Chargeback is that you have to have exhausted all avenues with the retailer before the Card Company give help.
As the transaction is over £100 it may be better to go for section 75 CCA on the grounds that no goods have been received. Section 75 is enshrined in law, Chargeback is a voluntary code.

I don't feckin think so!!
Am so bleedin cross!!
>>>What a shower of s h I t e. they are though.

But poster has admitted that "I got a mouthful of abuse from the delivery driver"

Now there must have been a reason for the delivery driver to act like that (if true) so what did the poster here say that provoked that sort of response?

A delivery driver is not going to talk like that without a reason.

We don't know both sides of the story so we don't know who was at fault.

Because I questioned why he did not phone me an hour before delivery as arranged because I was stuck in Belfast and my house is 40 minutes away. He then said he could try and deliver later but he then go sarcastic and stated that he had a wife and kid waiting at home and didn't have time to deliver ff to fussy pains in the asses. But that still does not warrant them taking all this money!!
Unless you have lost out in a material sense i can't see you getting any kind of discount.

sort of kind of

clearly the extra £2000 - shouldna
I think it is negligent
and that therefore they are responsible for consequential loss
such as charges for going over the limit
charges for letters and so on
( and what about that little fluffy teddy bear you couldnt buy your daughter because you were over the limit - you could jerk a few tears over that and the holiday you couldnt book)

so you can demand they put you back in the position you were in before spendng money on the fridge
You coud also demand they review procedures so that
a you arent abused
and b overcharging ( actually I dont even think this is overcharging) doesnt happen like this to someone else

and yes keep your temper

and as for
//Hopefully they can sort it out, since right appears to be on your side here.// and it IS a lot of money to lose so I hope its OK in the end - I dont know what I would do if I were £2900 down and every one just shrugged their shoulders with some hand-wringing

what sort of wquss writes that sort of thing
go at it girl !

Still no proper refund despite their promises. Any point in turning up at their office/show room tomorrow? There is till 2380 outstanding
Probably not. I would probably write to them in very strong terms - indeed "Letter before Action" type thing basically saying that they had no right to take the money, they have failed in their promises and if you do not receive a full refund within 7 days you will be taking them to Court.
