Her parents, (she moved back July last year), parents are now moving to sheltered housing, how long does the daughter need to be in the house to take /claim tenancy, Scottish council

why doesn't she just ask the council?
As I read it, the right to succeed to a secure tenancy applies only when a tenant dies; there is no such right when they are moved to sheltered housing:

Of course a particular council might have their own discretionary policies but there's no statutory right to succeed.

Thanks for both answers, she is a problem, just don't want the daughter taking overtenancy, think I will go and see the council myself the morn. thanks
If this is your neighbours why are you worried about it? Why are you seeing the council,it is not your house or family?
I think it's because twoboys regards the neighbours' daughter as "trouble" and so doesn't want her taking over the tenancy
If the daughter has been the official 'carer' for her parents and has no other home the council may be forced to rehouse her.
you don't have to go and see them.....just give them a ring to report i!

Sounds like Scottish Councils have a great system going,

I think you should only contact the Council if the Daughter's behaviour is breaching their rules.


The Tenancy issue is her business and theirs.
My guess is that the council will have families on a waiting list who have priority claim on the house if the legal tenants have moved out. The daughter (who I assume is single) would not qualify for a family sized house unless Scotland council housing rules are different to the rest of the UK, especially as she has lived there for less than a year (might be different if she had always lived there with her parents but still unlikely). I knew a guy who lived in a council house with his mum and had to move out when she died. He got a council flat because he was unemployed otherwise he would have had to find his own home. She will probably have to declare herself homeless when the council tells her they intend to move in a family that needs the house and hope they will offer her a flat, that's if she qualifies for social housing. I'd be very surprised if she's allowed to stay.
